LPAC Celebrates Historic Victory in the Challenge Against Florida’s “Don’t Say Gay” Law

In a landmark victory for equality and justice, LPAC, the nation's leading and only organization dedicated to electing LGBTQ+ women and nonbinary candidates to public office, proudly celebrates a historic settlement achieved in the challenge against Florida’s “Don’t Say Gay or Trans'' law. This monumental agreement, reached with the Florida State Board of Education, Florida Department of Education, and various school districts, marks a significant milestone in the fight for LGBTQ+ rights.


The settlement is a testament to the bravery and resilience of over a dozen parents, students, and teachers who stood up against discrimination, supported by the unwavering dedication of our allies. Together, we have successfully dismantled the most harmful provisions of this controversial law, ensuring it cannot be used as a weapon of discrimination against LGBTQ+ students, educators, and families.


“Time and again, we Floridians have stood firm against the tidal wave of anti-LGBTQ attacks from conservative lawmakers hell-bent on stripping us of our rights to live openly and fearlessly. With this landmark victory, we've sent a stinging rebuke to the Florida Republicans who dared to silence us,” said Janelle Perez, Executive Director for LPAC. “This settlement not only represents a victory for the LGBTQ+ community in Florida but also sends a powerful message across the nation that laws that seek to discriminate and marginalize will be met with staunch resistance. Our battle for true equality and unwavering inclusion is nowhere near its end. But, today, we stand victorious, not just for ourselves in Florida but as a beacon of resistance nationwide. I am proud to be celebrating this significant win alongside the teachers, children, activists, plaintiffs, and groups like Equality Florida who fought courageously to ensure LGBTQ+ Floridians can continue to work toward the promise of a future where everyone is embraced for who they are, regardless of who they love.”


Background: As a result of the litigation, this agreement effectively nullifies the most dangerous and discriminatory effects of the “Don’t Say Gay Law,” affirming that the law must be applied neutrally and does not permit discrimination against or the erasure of LGBTQ+ families. It represents a crucial step forward in ensuring that our schools are inclusive and safe spaces for everyone, regardless of sexual orientation, gender identity, or expression.
